What these terms cover

These terms cover your use of this website, and any evaluation or sandbox access we grant you.

The written agreement between your organisation and FinSour covers paid use of the APIs. Where that agreement and these terms say different things about the same subject, the agreement takes precedence.

Who may use FinSour APIs and services

FinSour provides verification APIs, and products and services built around them, to businesses. We sell them to organisations. We do not sell them to individuals acting in a personal capacity.

By accepting access, you confirm you are authorised to bind the organisation you act for. You also confirm that the registration details you give us are accurate.

What you may use the APIs for

You may use a verification API only to run checks your organisation has a lawful basis to run. You may run those checks only on people and businesses you have a genuine reason to check.

You agree that you will:

  • give the individual whatever notice, and get whatever consent, the law requires before you submit their details to a check;
  • run only the checks your stated purpose actually needs;
  • keep your API credentials confidential, and tell us promptly if you believe they have been exposed;
  • follow the conditions any issuing authority or source attaches to the data behind a check, including the rules that apply to Aadhaar.

You agree that you will not:

  • re-identify, enrich or profile an individual beyond the purpose you got their details for;
  • resell, redistribute or publish raw API responses, or use them to build a database or service that competes with ours;
  • use the APIs to discriminate unlawfully, or to monitor a person without a lawful basis;
  • try to get around rate limits, scrape the service, or share credentials outside your organisation;
  • represent a verification result as a decision we made about a person.

Sandbox and evaluation access

Sandbox access exists so you can build against the request and response shapes before you sign anything. Send it test values.

Do not send real personal data to the sandbox. If you do, you are responsible for it, and you should tell us so we can remove it.

Fair use and rate limits

Evaluation and sandbox access carry limits on how much you can call. We set them so one integration cannot degrade the service for everyone else.

Your agreement sets the limits for paid use. If you expect a spike, tell us beforehand and we will plan for it with you.

The data you send us

Your organisation is the data fiduciary for the personal data you submit to a check. We act as your processor, on your instructions.

You are responsible for the lawfulness of the checks you run, and for the notices and consents behind them. Our privacy policy and the data processing terms attached to your agreement describe how we handle that data.

Keep your own record of the basis for each check you run. If a person asks you why you checked them, that record is your answer, and we cannot write it for you.

What a verification result means

A verification result reports what the source record said at the time the check ran. It states a fact about that record. It is not a judgement about a person, a credit decision, a legal opinion, or a recommendation.

Decisions you make on the strength of a result are yours. Source systems can be unavailable, out of date, or internally inconsistent. Where a check cannot be completed, the API says so instead of guessing.

Availability and changes to services

We provide evaluation and sandbox access as it is, without an availability commitment. Your agreement sets the service levels for paid use, where they apply.

The published catalog changes as we add, revise or withdraw services. When we withdraw a service you use, we will tell you through the agreed channel before it stops being available.

Things outside our control

Some failures are nobody's fault. A source register can go down, a network can fail, a law can change overnight, and any of those can stop a check completing.

Neither of us is liable for a failure to perform caused by something genuinely outside our control. This does not excuse either of us from paying money that is already owed.

Intellectual property

This website, its text, illustrations, and the FinSour name and mark belong to us. Nothing on this site transfers any right in them to you.

Names and marks that belong to issuing authorities, regulators and other third parties stay theirs. They appear here only to describe what a service checks.

If you send us feedback or a suggestion, we may act on it and build it into the service, with nothing owed to you for it. You keep whatever rights you already had in the idea.

Confidentiality

An evaluation involves non-public information on both sides: pricing, documentation not published on this site, and technical detail about how a service works. That information is confidential. Neither of us should pass it on without the other's agreement.

Your responsibility for how you use the service

If we face a claim, a penalty or a regulatory action because of how you used the service, you cover us for it. That covers:

  • running a check without a lawful basis;
  • using a result for something you had no right to use it for;
  • breaking a condition an issuing authority attaches to its data.

This does not cover anything caused by us breaking our own obligations to you.

Suspension and termination

We may suspend or withdraw access where use breaches these terms. We may also do so where the law or a source authority requires it, or where continued access presents a security or legal risk. Where circumstances allow, we will tell you first, and we will say why.

You may stop using the service at any time. Some terms are meant to outlast access: confidentiality, intellectual property, your responsibility for past use, and anything in your agreement that says so. Those terms continue to apply.

Liability

For paid use, the agreement your organisation signs with us governs liability. Nothing on this page changes what that agreement says.

We provide this website, its documentation, and any free evaluation or sandbox access as they are, without warranty of any kind. We do not promise that they will be uninterrupted, error-free, or fit for a particular purpose. We do not accept liability for loss arising from your use of them.

Where the law does not allow a liability to be excluded, it is limited to the minimum the law permits. This does not limit liability for fraud, for wilful misconduct, or for anything else that cannot lawfully be limited.

How these terms work

A few mechanical points, in one place.

If a court finds one part of these terms unenforceable, the rest still stands. If we do not enforce something straight away, we have not given up the right to enforce it later.

You may not transfer your rights under these terms without our written agreement. We may transfer ours to a company that takes over the business these services belong to.

We send notices to the email address on your account, and you send them to the address at the end of this page.

Changes to these terms

If we change these terms, we will publish the new version on this page and change the date at the top. If you keep using the service after a change, you accept the revised terms.

Governing law

The laws of India govern these terms. The courts at Surat, Gujarat have exclusive jurisdiction over any dispute that arises from them.
